Hi, I´m a knowledge economics researcher and, making some graphs, I found that the numbers of trademarks registered are quite different in the USPTO and in  the US row of the WIPO -the difference isn´t based on the register office, or the Madrid System, as far as I know. The former data seems better, but it only goes back to 1974. The WIPO information, conversely, starts in 1883. So

I tried to register my trademark with the USPTO and they refused it because another company in the same market registered it before I did. I have used the trademark as my business name since 1998 and in commerce since 2003. I offer services. The other company is using the trademark to describe their books (goods that they sell) and applied to trademark it after my first use in commerce. The USPTO has requested me to file a Statement of Use, which should include "one specimen showing use of the mark in commerce for each class of goods/services." My company is a private holding company; it does not supply any goods or services. Its activity is based entirely on its equity capital (it does not raise money in the US or anywhere else nor does it invest other people's money as a portfolio management firm). It only trades in stocks (through US brokerage accounts)...

When trademarks are filed with the USPTO, do they do a common law search to see if the mark is in-use?

Or, do they only limit their searches to the USPTO database?

Are there any other databases they use to check a trademark?

Anyone know the field code to search for a particular NOA date in the Free Form (advanced) functionality of the TESS online search facility? (ie: [FD] = Filing Date, [RD] = Registration Date.  It seems weird that there appears to be no way to search on a date as significant as the NOA date) Anyone have any insight?

Assume a currently-existing website has a domain name that they have been using for several years, which is also their company name. They have not registered their trademark with the USPTO.

Another company has registered a confusingly-similar name in a somewhat related industry after the first company. They have registered their trademark with the USPTO.

Does the first company have any grounds for making the second company stop using the name? What about vice-versa?

I have been reading about T.M.'s on the USPTO website.  From what I gather, you must have a product or service in use before the mark can be registered.  So if someone has a patent or patent pending on a device and is looking to license to a company, they can't register a T.M on the device until the device is on the market?  So the initial products that the company sells would have the "mark" on it without the (R) ,then you have to send the proper proof of sale "...

OK guys, this will be a little vague because of the large players involved, but I will try to make it as clear as possible.

I currently sell polo shirts with my company name on them. When I am requested to send a sample to USPTO, do I send the acyual shirt or just the label ?

First, when registering a television program in the uspto, it seems that the "international class" to use is 041.  When I search the register, I see multiple U.S. classes listed afterward "IC 041" and these classes do not appear on the USPTO site.  Have they been added by the PTO? Is there somewhere I am not looking?  

Second, ideally, I would prefer to register the new name in all countries party to the Madrid Protocol initially, as opposed to just ...

In researching a trademark on Trademarkia I noticed that a company has picked up/registered a mark that had been abandoned by a large corporation. Two years later (after having been granted the mark by PTO) the new owner of the mark filed for an extension, which was granted in June 2012.
