So if someone trademarks Anytown Construction Company......

Does that mean anyone that lives in a place called Anytown cant open or operate a Anytown Construction Company even if thats the town they live in?  So the above would have rights to the name for every Anytown in the US?

My aunt's business name includes a small town name: X dental center.  Across the street a new dental office has opened with the name: X dental group.

Does she have any rights to oppose their name.  When patients call 411 for assistance it is very likely they will ask for X dental and receive the contact info for the other dental office.

What can she do?

The lawyer hired by the city of Branson had to explain his strategy at a alderman meeting. It turns out if you are trying to protect a name in a geographical area ? like the name Branson? all you have to do is threaten or evaluate any business that is using the name and is less then two years old. The threat is unclear if the business fails the evaluation but it would be assumed they would threaten a law suit ?as in the past? backed with tax payer money. I am on the board of directors of the Branson Sports Club, Inc., which is a nonprofit youth mentoring program in sports and education. The city name of Tadoussac, Quebec does not appear to be trademarked. Can I place that name on a product I create simply as a location? Can using "Tadoussac, Quebec" be prohibited by the municipality?

I want to try and trademark a slogan before the nfl draft this thur april 28. I want to use the name of two la rams players and los angeles rams football. I am asking if this is even legal or are the domains on those names off limits. This slogan would be at risk since if the rams don't draft the player I have in the slogan and take the other guy then this won't fly. Can you please let me know what you think and If you say its ok I will file and pay for a trademark. thanks alex pachano
