Workers Comp: lawyer vs. by myself
Posted by Anonymous . updated on 1/5/2009
The workers comp insurance company from my previous employer has been paying for my medical treatment from an injury 2 years ago, but now that my treating doctor wants a back surgery, they made me go to an IME who says I have no need. Further they have denied me visiting the treating docot any further. I'm currently out of work and have no insurance, but still able to work, despite serious pain. Should I get a lawyer to try to get a Workers Comp hearing or could I try to go it alone. I'm not really after any other compensation other then medical treatment and the lawyer I spoke to seems set on trying to find fault for my injury with my former employer, but it was just an accident. What should I do?

You should get a lawyer immediately. A lawyer however, will only take your case if you have" money moving", meaning that that you have been going to your doctor despite the no disability report and are entitled to past, present and future workers compensation benefits. Even if you do not meet the above criterea, some attorneys will take your case if you belong to a union, in hopes of future referrals. If you are in the ny metro area, please give me a call and let's discuss your case.
