terminating the guardianship of my daughter
Posted by Anonymous . updated on 10/9/2008
Last April me & my daughters dad signed over guardianship to his parents & my mom. They told us that they needed it so that they could put her in daycare & on their insurance. but ever since then my babysdaddys dad has been threatning to take my daughter away from me & never let me see her again because i'm the ''scum of the earth'' & don't deserve to have her. i'm in italy now & my daughter is still in florida. is there any way possible that i can terminate the guardianship from over here? i'm 17 by the way & my babysdaddy is 20...if that will make a difference in anything. we never went to court or anything like that, they just gave us papers from their lawyer & explained it to us & had us sign them & they sent them back. i now fully regret signing over guardianship, i thought it was a good idea, but all they've done since then was use her against me. i'm desperate for my daughter back. i love her with everything that i've got. i just need some advice or anything to get her back.

I have read your case. It is a very difficult situation. Under Italian law, the mother usually has the guardianship. Your age of seventeen at the time of the agreement would be a reason of invalidity, needing the assistance of a tutor. Unfortunately, I understand that you have to refer to U.S.A. legislation - you, your daughter and her father are all American citizens, and the settlement was signed in the U.S.A. - that authorizes this kind of agreement.
