Drunk Driving

If you are stop and given a breathalizer 2-3 times and the authorties decide to give you a courtesy ride home and then 3 hours later comes back to your resident and request that you go down for an offical BAC reading that surpassed 1.1 can you be charge for drunk driving after they broke the chain of cusody?

In italian law it is sufficient to repeat twice the breathalizer test with a result of over 0.5
