Blog accusation
Posted by Anonymous . updated on 1/3/2009
This incident happened 2 years ago but it has caused me emotional trauma and phobia. A course mate had set up a blog and defamed me and said that I was a flirt. I did not have a good school life for the 3 years in school and had a phobia. Lecturers commented I was not focused and seemed to have an avoidant personality. I cried everyday and I lost interest in my studies due to this blog and everyone shunned me. A group of them had a blog and claimed I was a flirt and big liar. I had seen many counsellors and they all just said I should let the matter rest but the incident had affected me badly in a way that I now have a phobia towards society. She used words like ''flirt'' ''bitch'' and ''gossip'' and the crux of her blog is defamation of me. The blog has not been removed and I want to know if I can sue her for damaging my reputation and self-esteem?

Unfortunately, in NY a defamation action must be commenced within 1 year from the date of the blog posting. You should also know that with defamation claim you have to pay the lawyer by the hour since they are never done on a contingency fee basis. In other words, you neeed $$$$ to prosecute a defamation claim. That is why wealthy people are usually plaintiff's in a defamation case.
